1. About Us
D3 – Domain Due Diligence is a service provided by Veniatis, a company registered in the Netherlands. Our registered address is Siriusstraat 4, 7622 VZ Borne, the Netherlands. You can reach us at [email protected].
2. Acceptance of Terms
By registering for or using the D3 platform (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms apply to all users, including both consumers and business customers.
3. Description of the Service
D3 is a SaaS platform providing domain due diligence, DNS analysis, trademark screening, reputation monitoring, typosquatting detection, and related domain intelligence tools. The Service is provided on a credit-based subscription model. Features, pricing, and availability may change at our discretion with reasonable prior notice.
4. Account Registration
To use the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account. Users must be at least 18 years of age or have the legal capacity to enter into contracts in their jurisdiction.
5. Credits & Payments
The Service operates on a prepaid credit system. Credits are purchased in advance and consumed when scans or other chargeable actions are performed. Credits are non-refundable once consumed. Unused credits do not expire as long as your account remains active.
Payments are processed securely via Mollie B.V. By making a purchase, you agree to Mollie's terms of service. Prices are displayed inclusive of any applicable VAT unless stated otherwise. Veniatis reserves the right to adjust pricing with 30 days' written notice.
For business customers: invoices will be issued upon request. We do not do paybacks unless legally required due to high costs. Disputed charges must be reported within 14 days of the transaction date.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
• Use the Service to infringe any intellectual property rights;
• Attempt to reverse-engineer, decompile, or access the Service's source code;
• Use automated tools to scrape, crawl, or abuse the Service beyond normal use;
• Use the Service to harass, harm, or monitor individuals without legal basis;
• Resell or sublicence access to the Service without our express written consent;
• Attempt to circumvent any security or access controls.
Veniatis reserves the right to suspend or terminate accounts that violate these provisions without refund.
7. Intellectual Property
All content, software, algorithms, designs, and data generated by the Service are the intellectual property of Veniatis or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your own internal purposes.
Scan results and reports generated for your account remain yours. You grant Veniatis a non-exclusive licence to process your input data solely to deliver the Service.
8. Data Protection & Privacy
Veniatis processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch data protection law. By using the Service, you consent to the processing of your personal data as described in our Privacy Policy.
We act as the data controller for account and billing data. For data processed on your behalf (scan input data), you remain the data controller and we act as a data processor. A Data Processing Agreement (DPA) is available upon request for business customers.
We implement appropriate technical and organisational security measures to protect your data. We do not sell personal data to third parties.
9. Availability & Service Levels
We aim to provide a reliable service but do not guarantee 100% uptime. The Service is provided "as is" and "as available". We reserve the right to perform maintenance that may cause temporary interruptions. We will endeavour to provide advance notice of planned downtime where possible.
For business customers: uptime commitments and SLA terms may be agreed separately in writing.
10. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Veniatis disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Scan results, DNS data, and reputation scores are provided for informational purposes only and should not be the sole basis for legal, commercial, or security decisions.
11. Limitation of Liability
To the fullest extent permitted by law, Veniatis's total liability to you for any claim arising out of or relating to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
Veniatis is not liable for: indirect, incidental, or consequential damages; loss of profits or revenue; loss of data; or damages arising from your reliance on Service output.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. Consumer rights under Dutch and EU law remain unaffected.
12. Termination
You may delete your account at any time via the account settings. Upon termination, your access to the Service will cease and any unused credits will be forfeited.
Veniatis may suspend or terminate your account immediately if you breach these Terms. We may also discontinue the Service with 30 days' written notice, in which case unused credits will be refunded on a pro-rata basis.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or via an in-app notification at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service before the effective date.
14. Governing Law & Disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent court in Overijssel, the Netherlands.
Consumers in the European Union may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
